These Terms of Service (“Terms”) govern your access to and use of our website itswhywerun.com and any purchases or interactions made through it.
By using our site or placing an order, you agree to these Terms.

2. Scope of These Terms

These Terms apply to:

• all merchandise purchases, pre-orders, and event ticket sales made through our online shop;
• the use of our website, social channels, and digital content; and
• any community memberships, promotions, or offers provided online.

Event participation is governed separately under our Event Terms & Conditions, which include medical, safety, behavioural, deferral, and refund rules.

3. Events and Ticket Sales

Why We Run organises endurance challenges, film premieres, and community events.
When you purchase a ticket to an event through our website or online shop:

• You are purchasing a non-transferable, non-refundable ticket, unless otherwise stated in the event listing or covered under the relevant Event Terms & Conditions.
• Entry and participation are subject to event-specific policies and eligibility requirements published on our website.
• For ticketed events such as screenings, talks, or community gatherings, your ticket secures entry to the stated event only. In the unlikely event of cancellation, refunds will be issued in line with our Refund Policy.

If there is any conflict between this document and the Event Terms & Conditions, the event-specific terms take precedence for all event-related matters.

4. Orders and Pre-Orders

Many of our products are offered on a pre-order or made-to-order basis.
When you place an order:

• Production begins once the pre-order window closes (typically within 7 days).
• Each item is produced specifically for you and cannot be cancelled, exchanged, or refunded once production has started.
• Please review all sizing and product details carefully before completing your purchase.

We reserve the right to refuse or cancel any order where necessary (for example, suspected fraud or unavailability).

5. Pricing and Payment

All prices are displayed in your local currency, determined automatically by your location or selected currency.
Prices include applicable taxes where required by law.

Payment is securely processed at checkout via Shopify Payments, Shop Pay, PayPal, Google Pay, or Klarna (where available).

If you choose to pay using Klarna, you agree to Klarna’s own Terms and Conditions and Privacy Notice.

Klarna’s payment options are subject to your financial circumstances, and approval is at Klarna’s discretion.
Using Klarna may involve a soft credit check that does not affect your credit score.

By selecting Klarna, you enter into a separate agreement with Klarna Bank AB (publ), and any questions or disputes about payment instalments should be directed to Klarna’s customer service.

If your payment currency differs from your card’s billing currency, your provider may apply its own conversion rate or fees.

6. Production, Shipping, and Delivery

After the pre-order window closes, manufacturing typically takes up to two weeks.
Orders are shipped directly from our apparel partner BRAV Endurance to you.
You will receive a confirmation email with tracking details once your order dispatches.

UK delivery is free of charge; international shipping rates are calculated at checkout.
Customers are responsible for any customs duties or import taxes.

7. Returns and Refunds

Because made-to-order items are produced individually, we cannot accept returns or exchanges for incorrect sizing, colour selection, or change of mind.
This aligns with UK Consumer Contracts Regulations, which exclude custom-made goods from standard return rights.

If an item arrives damaged or incorrect, contact us within 7 days of delivery at shop@itswhywerun.com with photos and your order number.
Where appropriate, we will arrange a replacement or refund.

If your purchase was made using Klarna, any refund will be processed via Klarna and returned to your original payment method. Refund timing is determined by Klarna’s refund process.

Event ticket refunds are handled in line with our Refund Policy and, where applicable, Event Terms & Conditions.

8. Accuracy of Information

We make every effort to ensure that product descriptions, prices, and event information are accurate and up to date.
We reserve the right to correct any errors or update information without prior notice.

9. Intellectual Property

All text, images, logos, and graphics on this site are owned by Why We Run Ltd or our licensors and protected by copyright and trademark laws.
You may not copy, reproduce, or use any material without our written consent.

10. Limitation of Liability

To the fullest extent permitted by law, Why We Run Ltd is not liable for any indirect, incidental, or consequential damages arising from the use of our website, event attendance, or purchased products.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, or for fraud.

11. Privacy and Data Protection

We handle personal data in accordance with our Privacy Policy.
For merchandise fulfilment, limited customer information (such as name and delivery address) may be shared securely with BRAV Endurance solely to produce and deliver your order.
For event ticketing, attendee information (such as name, contact details, and dietary or accessibility notes) may be shared securely with our authorised event partners for operational purposes.
All partners are contractually bound to protect your data.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales.
Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
